Vengeful Brooklyn ex-con taunts domestic violence prosecutor with chilling threats: feds

Sep. 2--A vindictive ex-con who recently moved to Brooklyn made a series of chilling death threats against a Missouri prosecutor who helped put him behind bars for five years in a domestic violence case, federal authorities said.

Scott Smith, who was out on parole after serving half a decade in a Missouri prison, told the prosecutor during an Aug. 3 phone call he'd "happily sit in a cell and await the needle" after killing her, according to federal court filings. He even vowed to carry out the killing in front of the victim's 5-year-old daughter.

"You remember me, don't you?" taunted Smith, who identified himself during the sick phone call, the complaint alleges.

"I just want to tell you, you are about to die ... that little girl in the background is going to watch you die," he said, referring to the prosecutor's daughter.

The 38-year-old felon was first busted in Fulton, Mo., on Nov. 26, 2014, for assault and felonious restraint in a domestic violence case. He pleaded guilty almost a year later and was sentenced to seven years behind bars, including time served.

Last month, the prosecutor, who is now a judge, got the chilling call from a Missouri area code, about five months after Smith was released to parole, according to a federal criminal complaint. Her name was not publicly released as part of the new case against Smith.

The judge hung up, but Smith followed with a string of threatening text messages later that day from the same number, according to the complaint.

"Did you really think you were going to smirk at me in the courtroom for keeping me locked up for a crime I didn't commit and get away with it?" he texted, according to the complaint. "Five years I've been waiting for what's about to happen. I've fantasized about it every single night for years."

"My life for your life. I swear it to God," he also wrote, claiming he'd become a "martyr for this."

"You love your 5-year-old? I loved mine. He doesn't know me now. He did, but doesn't now. You did that," he continued, according to the complaint. "I [can't] wait to see the look on your face when you feel EXACTLY the way I do. Then I'll end your misery, as I could never do to a human being what you've done to me."

He also texted the former prosecutor that he'd kill the victim from the 2014 domestic case, court papers say.

And on the same day, he allegedly left the ex-prosecutor a voice mail, warning he'd "put a bullet in a child right in front of [her]," and that he didn't care if he was executed because the killing would make "national news" as a warning to other prosecutors.

Investigators in Missouri figured out the caller was dialing from Brooklyn, officials said. The Callaway County sheriff's office promptly filed a felony harassment investigation and requested assistance from the FBI, officials said.

By that night, the NYPD arrested Smith in his Bedford-Stuyvesant home.

Smith's Brooklyn neighbors said he lives with his girlfriend -- and that they often heard the couple fight.

"They would call the police like once every three days," said one man, who declined to give his name.

"[There's] a lot of screaming, a lot of banging ... things falling down the stairs," said another neighbor, who also declined to give her name. The woman said residents saw members of law enforcement arrest Smith at the building last month.

On Aug. 16, a judge ordered that Smith, who is in federal custody, be held without bail.
