Two men sentenced for child sexual assaults in Logan County

April 20--Associate Judge William Workman last month sentenced two men with ties to Logan County to a total of 33 years in prison for the predatory criminal sexual assault of children they were related to by marriage.

Radespiel

As part of a plea bargain with the state on March 20, Markus L. Radespiel, 53, a former resident of both Lincoln and Atlanta, pled guilty to the Class X felony of predatory criminal sexual assault of a child under the age of 13. Radespiel was sentenced to 23 years in the Illinois Department of Corrections and will be required to serve at least 85 percent of his sentence before becoming eligible for parole.

Radespiel was married to a relative of the six-year-old victim at the time of the assault. DNA evidence ultimately supported the claims against him. Logan County State's Attorney Jonathan Wright said Friday the Lincoln Police Department conducted an investigation after the child disclosed the allegations of assault to a family member. Radespiel was arrested and charged in June of 2017.

On March 22, Radespiel was admitted to the Graham Correctional Center, in Hillsboro, Ill., with a projected parole date of December 31, 2036. Upon discharge, he will be subject to a mandatory supervised release period of three years to life.

Gutierrez

Guillermo Gutierrez, 35, formerly of Glendale, Ariz., was sentenced on March 20 to 10 years in IDOC after he pled guilty to the Class X felony of predatory criminal sexual assault of a child under the age of 13. At the time of the offense, Gutierrez was married to the victim's mother, a former resident of New Holland.

In 2016, LPD investigated the allegations against Gutierrez after the victim reported the abuse to the Illinois Department of Children and Family Services during an unrelated investigation. Wright said Friday that DNA evidence was not involved in this case due to the timing of the disclosure and the nature of the allegations.

Gutierrez was admitted to the Graham Correctional Center on March 22 with a projected parole date of November 26, 2025. He is required to serve at least 85 percent of his 10-year sentence. Upon discharge from prison, he will be subject to a mandatory supervised release period of three years to life.

Other recent sentences in Logan County Courts

Richards

On April 3, Scott W. Richards, 44, of Lincoln, was sentenced to seven years in prison for the Class One felony of unlawful possession of cannabis with intent to deliver. Richards pled guilty as part of a plea bargain with the state stemming from a 2017 raid of his home at 106 Wyatt Avenue. Wright said this week that LPD became aware of Richards activities as a drug dealer during an unrelated investigation.

"Police obtained a search warrant for the house and discovered 2,570.6 grams of cannabis along with firearms and $10,430," Wright said. "The firearms and currency were seized by [the] Lincoln Police and this office secured a forfeiture of those items in a separate proceeding."

Richards was admitted to the Graham Correctional Center on April 5 with a projected parole date of April 30, 2021.

Parker

Brad W. Parker, 34, of Lincoln, was sentenced April 3 to a total of eight years in IDOC after he pled guilty to the Class Two felonies of unlawful possession of a stolen certificate and unlawful possession of a weapon by a felon. He was sentenced to three years for the former charge and five for the latter. Those sentences are to be served consecutively.

Last year, the Atlanta Police Department received a report that a vehicle and its registration paperwork were stolen from a home on Northeast Fifth Street. "The vehicle was not recovered, but the certificate of title was signed by Brad Parker as purchaser," Wright said of the case this week. "The owner of the vehicle stated that he had not sold the vehicle to Brad Parker."

Parker, who was a convicted felon at the time, was later caught leaving the Lincoln Wal-Mart with a box of 12-gauge ammunition that he had not purchased, which resulted in the second charge against him in this case. He was admitted to the Graham Correctional Center on April 5 with a projected parole date of August 6, 2021.

Elwood

Phillip O. Elwood, 38, of Lincoln, was sentenced April 4 to three years in prison after he pled guilty to the Class Four felony of aggravated fleeing and eluding a peace officer.

Earlier this year, the Logan County Sheriff's Department ran the registration on a Nissan Sentra driven by Elwood, which was spotted near the intersection of 11th and Union Streets in Lincoln. The plates came back as expired and registered to a 2011 Chevrolet. The deputy flipped on his emergency lights and attempted to pull the car over, but Elwood refused to stop the vehicle. He later admitted that he fled because he did not have a valid driver's license and knew the registration belonged to a different vehicle.

He was admitted to the Graham Correctional Center on April 5 with a projected parole date of September 5, 2019.
